Negligence

Negligence is the dominant legal theory in First Court’s history of researching American juries. What continually surprises us is how few lawyers succeed in defining negligence to a jury in a way that really helps jurors in the deliberation room.

This is a sad commentary on American advocacy. It means that instead of following the law, jurors will do whatever feels fair.

Should you choose to hire First Court to help evaluate your negligence case, we will uncover some practical tools to address this problem. There is no reason for leaving a jury without guidance on the most critical concept in a negligence trial.
