
Catastrophic Injury

At least 85 of First Court’s cases in the last 20 years have involved very serious injuries or death. Typically we see jurors wanting to help the surviving spouse, or the person in a wheelchair, or the victim whose face has been burned off.
On the other hand, the liability claim in many of these gruesome injury cases is thin. The critical question often centers on how a local jury will balance the desire to help the victim against the weakness in a claimant’s liability or causation claim.
